A Madrid-based court has decided to initiate legal proceedings for "genocide" against 27 leaders of Polisario as a result of a complaint by the Saharawi Association for the Defense of Human Rights (ASADEDH), filed on 26 December 2007.



The decision was made recently by the Central Court of Instruction N ° 5 of the National Audience, the highest Spanish court, after a legal appeal by the Attorney Luciano Rosca Nadal. It aims to determine the facts and responsibilities of people involved.

In this context, the court decided to issue a rogatory letter to the Algerian  authorities against the twenty-seven leaders of Polisario. The purpose of this letter is to determine whether the facts raised in the complaint are the subject of an investigation or trial in Algeria. It also aims to establish if similar procedures were undertaken in Morocco against the same individuals.

According to the court ruling, the judicial proceedings concerning the so-called "Sidahmed Battal, Sidi Wagag, El Jalil Ahmed, Brahim Ghali, Jandoud Mohamed, Abdelwodoud El Feri, Mohamed Salem Sanoussi, Brahim Beidila, Mahjoub Lincoln, Mohamed Lamine Bouhalli, Edda Hmoim, Ahmedu Bad, Ali Dabba, Bachir Moustafa Ayed, Mohamed Jadad, Nolud Lensen, Mohamed Hnya, Mohamed Ali Hnya, Luchaa obeid, Molud Didi, Mahfoud Hmeina Duihi, Mohamed Fadiln, général Omari, Kadour Nabil, Nadim Benaser, Mahfoud et Abderrahman Bouh.". This list would include three Algerians.

The Sahrawi Association for the Defense of Human Rights had filed a complaint to the Spanish justice for genocide against Polisario leaders, including Brahim Ghali, who was then the separatists representative in Madrid. He was immediately called in Algeria and replaced, fearing possible arrest by the Spanish judicial authorities.
