The participants in an international symposium, organized on Saturday evening on the recent directions of the Spanish Supreme Court and their relationship with parallel diplomacy, affirmed that the decisions recently taken by this Court in relation to the territorial integrity of the Kingdom is a “big blow” on the so-called Polisario front and an “achievement” for Moroccan judicial diplomacy.


The decisions of the Spanish Supreme Court mainly concern the decision to ban the occasional or permanent use of “unofficial” flags or any political expression inside and outside public buildings, as well as the judgment emanating from the Civil Chamber of the Court which refused Spanish nationality to a citizen born in 1973 in the southern provinces of Morocco, after the appeal brought by the General Direction of Legal Security and Public Faith against a verdict rendered by the Balearic regional court which granted nationality to this national, on the basis of article 17.1 of the Civil Code.
The president of the Amicale hassania des magistrats, Abdelhak Ayassi, underlined, during this conference held by videoconference under the title “Kingdom's territorial integrity through parallel diplomacy: Reading in the recent guidelines of the Spanish Supreme Court” , that this meeting is part of initiatives organized by the Amicale to mobilize support and confront the incongruous proposals of enemies of the territorial integrity of the Kingdom.
He added that the Amicale hassania des magistrats, co-organizer of the colloquium with its office at the Court of Cassation, places at the center of its priorities the visibility of the national cause of the Kingdom and human rights achievements made by Morocco led with wisdom and lucidity by His Majesty King Mohammed VI, president of the Superior Council of the Judicial Power (CSPJ).


He mentioned, in this regard, the seventh Moroccan-Spanish meeting between the Court of Cassation of the Kingdom of Morocco and the Supreme Court of the Kingdom of Spain, held last February in Marrakech, which was attended by the deputy president of the CSPJ and First president of the Court of Cassation, Mustapha Fares, the president of the Spanish General Council of the Judicial Power (CGPJ) and president of the Supreme Court of Spain, Carlos Lesmes Serrano.




Hassan Fetoukh, adviser and president of the office of the Amicale hassania, stressed that the decision of the Spanish Supreme Court to prevent the occasional or permanent use of “unofficial” flags, in particular flag of the puppet republic, is of capital importance, since the decisions of this institution are indisputable, because their impact extends to regional and European organizations.
This decision constitutes a “huge blow” on the fictitious Sahrawi republic, “taking away the fictitious legitimacy” of this entity and beats the separatist theses which are conveyed on Spanish soil, affirms Mr. Fetoukh, noting that the European Court adopted the same approach in 2018 after rejecting the appeal brought by Polisario against the maritime fishing agreement with Morocco, pretending that the entity does not have legal status for its establishment.


The new judicial orientation of the Spanish Supreme Court is also in line with the response by the United Nations Security Council to the protest by Algeria against the opening of consulates of some African countries in the southern provinces of the Kingdom, since it is a “sovereign decision” which constitutes “an additional legal victory for the Kingdom and success of the official and parallel diplomatic strategy”, he added.
Hilal Tarkou Lahlimi, president of the Association of lawyers of Moroccan origin in Spain, described the recent decisions of the Spanish Supreme Court as Knock out for the separatists who exploit all means to profit from Moroccans detained in Tindouf camps in southern Algeria.


Mr. Tarkou, also president of the Association of the network of Moroccan lawyers of Moroccan origin practicing abroad, considered that the decision to prohibit occasional or permanent use of “unofficial” flags or any other Political expression inside or outside of public buildings on Spanish soil constitutes a “final point” for this exploitation by Polisario, fictitious entity, which will be struck several times thereafter.
brahim Sadouq, president of the National Justice Authority, underlined, in his speech, that the recent decisions of the Spanish Supreme Court is“one of the fruits of communication” adopted by Moroccan diplomacy, notably the judiciary , within the framework of the presentation and defense of the cause of the territorial integrity of the Kingdom.
It was diplomacy that led to the withdrawal by many countries of their recognition of the puppet Saharawi Republic, he added.These decisions are“a categorical legal denial” of any legal status of a fictitious entity called Polisario and are part of the defeats which continue to be inflicted on it, like the decision of the European Court to dismiss the action brought by Polisario against the fishing agreement with the Kingdom, he said
